TERMS AND CONDITIONS FOR DRIVERS

This document is an electronic record under the Information Technology Act, 2000 and applicable rules. By registering on or using the Platform, you (“Captain”/“you”) agree to be bound by these Terms and Conditions (“T&Cs”). Please read them carefully before proceeding. If you do not agree, you must not use the Platform.

These T&Cs supersede all prior agreements or arrangements with you. Your continued use of the Platform constitutes acceptance of these T&Cs, our Privacy Policy, and any updates made by the Company.

1. Use of the Platform

  • The Platform is a Software-as-a-Service (SAAS) tool that helps Captains (auto/cab drivers) connect with customers (“Customers”) for ride services.

  • The Platform only enables lead discovery; actual ride services are provided by you directly to your Customers.

  • You are solely responsible for your rides, pricing, customer service, and compliance with applicable laws.

2. Registration and Eligibility

  • To register, you must:

    • Be at least 18 years old with a valid driving license.

    • Have a minimum of 2 years driving experience.

    • Have no pending challans against your vehicle prior to onboarding.

    • Not have been convicted (in the past 3 years) of DUI, fraud, sexual offences, violent crimes, theft, or terror-related offences.

  • You must provide accurate and up-to-date information and documents during onboarding.

  • You are responsible for safeguarding your account credentials. The Company will not be liable for misuse or unauthorized access to your account.

3. Driver Information and Privacy

  • “Driver Information” includes your KYC details, mobile number, documents, and other information submitted.

  • You authorize the Company to:

    • Collect, process, and use this information for business, service, analytics, and compliance purposes.

    • Share information with government authorities or third parties where legally required.

  • You must provide only true and accurate information. The Company is not responsible for verifying accuracy.

4. Payments

  • Ride fares for carpool services will be available within 3 hours after the trip ends. If you have any questions or issues, please raise a support ticket through the app’s ticket module within defined time duration which is 90mins after ride completed. 

  • Drivers are responsible for:

    • Issuing invoices to Customers (as per GST or applicable laws).

    • Collecting and remitting all taxes related to rides.

  • The Company is not liable for fare disputes, cancellations, or refunds between you and your Customers.

5. Relationship with the Company

  • The Company is not a ride service provider.

  • You are an independent service provider.

  • Nothing in these T&Cs creates a partnership, employment, or agency relationship between you and the Company.

6. Confidentiality

  • You must maintain the confidentiality of all customer data, business information, and Platform content.

  • Confidential Information includes technical, operational, financial, or customer-related data.

  • Such information must not be shared with third parties, except as required by law.

7. Intellectual Property

  • The Platform, its design, content, and trademarks belong to the Company.

  • You receive a limited, non-exclusive, revocable license to use the Platform for personal use.

  • You must not copy, modify, reverse engineer, or commercially exploit the Platform.

8. Indemnity

You agree to indemnify and hold harmless the Company, its directors, employees, and affiliates from claims, losses, or liabilities arising from:

  • Your breach of these T&Cs.

  • Your provision of ride services.

  • Misuse of the Platform.

9. Disclaimers

  • The Platform is provided on an “as is” basis.

  • The Company makes no warranties on reliability, accuracy, availability, or error-free operation.

  • You use the Platform at your own risk.

  • The Company is not responsible for the quality, safety, or conduct of Captains or Vehicles.

10. Termination

The Company may suspend or terminate your access immediately if:

  • You violate these T&Cs or applicable laws.

  • You misuse the Platform.

  • Your conduct harms the Company’s business interests.

On termination, you must stop using the Platform immediately.

11. Governing Law and Dispute Resolution

  • These T&Cs are governed by the laws of Gujarat, India.

  • Courts of [City, e.g., Ahmedabad] will have exclusive jurisdiction.

  • Disputes will first be resolved amicably; failing which, arbitration under the Arbitration and Conciliation Act, 1996 will apply.

12. Notices

  • Company notices will be sent via email, Platform notifications, or post.

13. Amendments

  • The Company may modify these T&Cs at its discretion.

  • Updates will be posted on the Platform and will take effect immediately.

  • Continued use of the Platform implies acceptance of updated terms.

TERMS AND CONDITIONS FOR USERS/RIDERS

This document is an electronic record under the Information Technology Act, 2000 and applicable rules. By using the Cab-O mobile application or website (“Platform”) owned by [OBAC TECHNOLOGY PRIVATE LIMITED] (“Cab-O”, “we”, “us”, “our”), you agree to the terms below. If you do not agree, please do not use the Platform.

1. About the Platform

Cab-O provides a technology-based Software-as-a-Service (SaaS) Platform that enables users (“you”, “User”) to connect with independent third-party drivers (“Drivers”) who offer passenger transport services via autos, cabs, or other vehicles.

Cab-O itself does not own vehicles, employ drivers, or provide transportation services. All rides are agreements between you and the Driver.

 

2. User Obligations

By registering and using the Platform, you confirm:

  • You are at least 18 years old.

  • You will use the Platform in compliance with applicable laws.

  • You will provide true, accurate, and complete information when creating your account.

  • You are solely responsible for keeping your login details secure.

  • You will not transfer or share your account with others.

3. Use of Platform

  • You may view available Drivers, request rides, and agree on fares.

  • Payments, refunds, and cancellations are between you and the Driver only. Cab-O is not a party to ride contracts.

  • Cab-O may show estimated fares for guidance, but the final fare is agreed directly between you and the Driver.

  • Cab-O may modify, suspend, or discontinue Platform access at its discretion.

4. Payments

  • Ride fares are to be paid directly to the Driver, including applicable taxes in case of Taxi service. For Carpool services, online payment is mandatory. If you have any questions or concerns about charges or payments during or after the trip, please raise a support ticket through the app within 90 minutes of trip completion. The support ticket option is also available once your booking is accepted.

  • Invoices, if any, are issued once ride completed.

  • Cab-O is not responsible for fare disputes, refunds, or collections.

 

5. User Conduct

You agree not to:

  • Use the Platform for unlawful, harmful, or fraudulent activities.

  • Create multiple or fake accounts.

  • Interfere with Platform operations (e.g., using bots, viruses, or denial-of-service attacks).

  • Post content that is illegal, offensive, or violates third-party rights.

Cab-O reserves the right to suspend or terminate accounts for violations.

6. Communication

Cab-O may contact you (via app notifications, customer support via or email) in case of emergencies, technical issues, or safety concerns.
We are not responsible for delays, failures, or distortions in communications.

7. Disclaimers

  • The Platform is provided on an “as-is” basis without warranties.

  • Cab-O does not guarantee uninterrupted or error-free service.

  • Drivers are independent service providers; Cab-O is not liable for their actions, vehicle quality, or ride experience.

  • Your use of the Platform and rides is at your own risk.

8. Intellectual Property

  • All rights to the Platform, content, trademarks, and technology belong to Cab-O.

  • You are granted a limited, non-transferable license to use the Platform for personal purposes only.

9. Third-Party Links

The Platform may display third-party ads, promotions, or links. Cab-O is not responsible for their content, services, or privacy practices.

10. Termination

Cab-O may suspend or terminate your access without notice if you:

  • Breach these Terms, misuse the Platform, or engage in fraudulent activity.

  • Act in a way harmful to Cab-O, its users, or third parties.

11. Governing Law & Dispute Resolution

  • These Terms are governed by the laws of Gujarat, India.

  • Disputes will first be attempted amicably, failing which arbitration under the Arbitration and Conciliation Act, 1996 will apply.

12. Changes to Terms

Cab-O may update these Terms at any time. Updated Terms will be posted on the Platform, and continued use constitutes acceptance.
